On February 21, 2025, our office commenced a proposed class action against Apple Canada Inc. and Apple Inc. (collectively, “Apple”), on behalf of all persons in Canada who purchased and/or owned any Apple Device equipped with Siri from October 1, 2011 to present (“Class Members”). The action claims that Apple, through the Siri function on its Apple Devices, has knowingly accessed and recorded Class Members’ private and confidential conversations without their knowledge or consent for Apple’s own commercial and financial gain.
The action further claims that Apple has been profiting off of Class Members by not only using their personal information to advance its own technology, but has also been selling Class Members’ personal information to third-party marketers. The action seeks compensation on behalf of Class Members and a declaration that Apple’s conduct is a violation of Class Members’ right to privacy and that it is in breach of federal and provincial privacy and consumer protection laws.
Apple Devices include but are not limited to the following:
- iPhones;
- iPads;
- AirPod headphones;
- MacBook laptops and iMac computers;
- Apple Watches; and
- HomePod smart speakers.
