Update: October 3, 2023
We are pleased to announce that the class action in Lindhout et al. v. Hill’s Pet Nutrition Inc. et al., has been certified for settlement purposes on behalf of individuals who purchased certain Hill’s products that allegedly contained excessively high levels of vitamin D and the Settlement has been approved by the Ontario Superior Court of Justice.
If you purchased one of the Products listed in the Notice (below) in Canada between September 1, 2018, to May 31, 2019, you could be eligible to make a claim for compensation. All claim forms must be submitted by March 26, 2024. If you do not make a claim by this date, you will not be eligible for any compensation as part of this lawsuit.
If you do not wish to participate in the class action and Settlement, you must remove yourself by completing an Opt-Out Request and send it to the Settlement Administrator, no later than the Opt-Out Deadline of November 20, 2023.

Update: June 20, 2023
We are pleased to announce that a proposed Settlement has been reached in the class action lawsuit against Hill’s Pet Nutrition Inc. (the “Defendant”): Lindhout et al. v. Hill’s Pet Nutrition Inc. et al. The lawsuits alleges that the Defendant was negligent in the research, development, testing, manufacture, production, marketing, advertising, promotion, distribution, sale and warranty of the Defective Products. The Defendant denies those allegations, and the Court did not decide who was right. The Parties have instead decided to settle the lawsuit.
This class action is brought on behalf of all persons resident in Canada who purchased Hill’s canned Prescription Diet and Science Diet dog foods with the following Product Name, SKU Number and Date Code/Lot Code which products were recalled due to elevated amounts of vitamin D:

Settlement Approval Hearing:
The Toronto Court will hold a Settlement Approval Hearing on September 21, 2023 to consider whether or not to approve the proposed Settlement.
Note: At this time, there is no money available for Class Members. The claims process has not yet begun. If the proposed Settlement is approved, Class Members may make a Claim for compensation under the Settlement.
Your Legal Rights and Options:
- You can participate in the Settlement, if the proposed Settlement is approved by the Court, and submit a Claim for compensation. If you wish to participate, you are not required to do anything until after the Settlement is approved.
- You can object to the proposed Settlement before the Court considers whether to approve it and attend the Settlement Approval Hearing to present that objection. If you wish to object to the proposed Settlement, you must submit a signed and completed Objection Form to the Claims Administrator on or before August 18, 2023.
