In March 2010, a class proceeding was commenced against Bayer Inc. on behalf of all persons in Ontario who used Yasmin® and YAZ® between the times these drugs were first made available in Canada (2004 and 2008 respectively) and November 30, 2011.
The claim alleges that both Yasmin® and YAZ® are associated with an increased risk of suffering various types of blood clots and gallbladder disease, compared to other available oral contraceptives. The claim further alleges that the increased risk was known to Bayer Inc. and they failed to timely or adequately communicate the risk information to consumers and the medical community.

On April 15, 2013, the Honourable Justice Crane of the Ontario Superior Court of Justice certified this case as a class proceeding. View a copy of the certification decision here.

The Ontario action applies to all residents of Ontario who were prescribed Yasmin and/or Yaz prior to November 30, 2011.
The Saskatchewan action applies to all residents of Canada, excluding Ontario and Quebec, who were prescribed Yasmin and/or Yaz prior to September 17, 2015.
The Quebec action applies to all residents of Quebec who were prescribed Yasmin and/or Yaz prior to November 30, 2011.
On August 5, 2015, Bayer filed its Statement of Defence. Attached is a copy of the Statement of Defence.
On September 17, 2015, the Saskatchewan Court released its certification decision indicating that it will certify a Yasmin/Yaz class action for Canadians outside of Ontario and Quebec subject to having the litigation plan updated. On February 15, 2019, the Quebec Court authorized a class action against Bayer Inc.. On May 14, 2019, the Quebec Court approved the notices to members (French and English), aiming to inform them from the above and of their right to opt-out.
